Judge Throws Out Olsen Residency Filing

A judge has thrown out a filing from a Stafford County resident claiming Eric Olsen, whose running for Commonwealth Attorney in that county, does not live in Stafford. State election officials require candidates to live in the jurisdictions they wish to represent. More to come. 

Stafford, Va. — A Prince William County Circuit Court judge will appear in Stafford on Friday in a filing pertaining to a candidate running to be that county’s next Commonwealth Attorney.

Lon Edward Ferris has been tapped by the Virginia State Supreme Court to chair a proceeding held to bring together Stafford Assistant Commonwealth Attorney, and current CA candidate, Eric Olsen and David Johnston, the resident who filed a Writ of Quo Warranto alleging Olsen is ineligible to run for the position because he does not live in Stafford County, according to Johnston’s attorney John L. Bauserman, Jr.

Olsen could not immediately be reached for comment.

The public hearing is set for 2 p.m. in Stafford Circuit Court. Judges at the Stafford Courthouse recused themselves from chairing the proceeding, prompting the need for outside oversight.

“I think that was the right thing for them to do, as many of them have worked closely with Olsen over the years,” said Bauserman.

Ferris will have to decide if there is enough evidence in this case to warrant a hearing, and that decision could come tomorrow afternoon, said Bauserman.

The court appearance will come just days before the General Election on Tuesday. Olsen is facing Independent Tim Barbrow.

State law requires that Olsen live in the jurisdiction he wishes to represent. The filing against him alleges he was never a resident of the county when he field paperwork to run for seat and that he still lives in his home in Fredericksburg.

Olsen has worked as an assistant commonwealth attorney under outgoing CA John Chichester since 1989.

His residency was in an issue this year during the Primary Election in August, when maintained he is in the process of selling his home in Fredericksburg – where his wife and family remain – and that currently lives in a garage apartment on Poplar Road in Stafford County.

The filing alleges that address is not recognized as a single domicile and does not meet the residency requirements to run for office in the county.
